1. Introduction and Acceptance
Welcome to OYOS, your AI-powered behavioral intelligence platform. These Terms of Service ("Terms") govern your access to and use of OYOS.ai's platform ("Service"), owned and operated by OYOS Technologies LLC ("we," "our," or "us").
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which governs how we collect, use, and protect your data. If you do not agree to these Terms, do not use the Service.
These Terms apply to all users of the Service, including individual users, agency partners ("Partners"), their clients ("Customers"), and any authorized users.
2. Service Description
OYOS.ai is an AI-powered behavioral intelligence platform that provides:
- Interactive DISC personality assessments using voice AI technology
- Personalized professional coaching sessions with AI-powered insights
- Behavioral analytics and progress tracking
- Goal setting and achievement monitoring
- Team dynamics analysis and recommendations
- White-label portal customization for agency partners
- Real-time analytics and reporting tools
OYOS does not provide legal, medical, or psychological services. The insights and recommendations offered should be used as guidance and not as a substitute for professional advice.
3. User Roles and Responsibilities
3.1 Individual Users
Individual users can access DISC assessments, coaching sessions, and personal development tools directly through the platform.
3.2 Agency Partners
Partners are agencies or platform resellers who use the Service to create, manage, and provide voice AI services to their own end clients through white-labeled instances of the platform.
3.3 Customers
Customers are organizations or individuals who receive services directly from the OYOS.ai platform or from Partners via white-labeled instances.
4. Account Registration and Eligibility
To use OYOS, you must:
- Be at least 18 years old or have parental/guardian consent if under 18
- Provide accurate and complete registration information
- Maintain the confidentiality of your login credentials
- Use the platform for lawful purposes and in compliance with applicable regulations
- Ensure that any users you authorize comply with these Terms
Partners may invite their Customers to use white-labeled versions of the platform. Partners are responsible for managing Customer access and ensuring Customers' compliance with these Terms.
5. User Responsibilities and Acceptable Use
By using OYOS, you agree to:
- Maintain the confidentiality of your login credentials
- Use AI-generated insights responsibly and acknowledge that AI has limitations
- Provide honest and accurate information during assessments
- Respect the intellectual property rights of OYOS and other users
- Not attempt to reverse-engineer, copy, or misuse OYOS's proprietary technology
5.1 Prohibited Activities
You may not use the Service to:
- Upload or transmit any unlawful, harmful, or infringing content
- Violate the rights of any third party
- Engage in malicious activity including spam, phishing, or system abuse
- Circumvent access controls or breach the security of any system
- Share offensive, illegal, or harmful content
- Impersonate others or provide false information
5.2 Enforcement
Violation of these policies may result in immediate suspension or termination of your account, removal of prohibited content, and possible legal action.
6. Data Ownership and Privacy
6.1 Your Data Ownership
You retain all rights and ownership to the data you upload, store, or process via the Service, including voice recordings, assessment responses, and personal information.
6.2 Data Controller and Processor Roles
For jurisdictions governed by data protection laws such as GDPR and Qatar's Personal Data Privacy Protection Law, Partners act as Data Controllers, and OYOS.ai acts as a Data Processor. Partners are responsible for ensuring lawful data collection, processing, and obtaining required consents.
6.3 Our Use of Data
We may use aggregated and anonymized usage data to improve platform functionality and service offerings. This data will not identify any individual user or organization.
7. AI Usage and Ethics
OYOS uses advanced AI models to deliver coaching insights and behavioral analysis. Important considerations:
- While we strive for accuracy and fairness, AI-generated recommendations may not always be free from bias
- AI insights should be used as guidance, not absolute truth
- Users have the right to request human intervention when AI-driven decisions significantly impact them
- We continuously work to improve our AI models and reduce potential biases
- Voice recordings are processed using secure, industry-standard AI services
8. Platform Customization and White-Labeling
Partners may configure the platform with their own branding and client-facing domain. All white-labeled instances are hosted on OYOS.ai infrastructure.
Partners are responsible for:
- Representing to their Customers the nature of the service provided
- Ensuring compliance with any third-party branding or marketing claims
- Managing customer relationships and support
- Obtaining necessary permissions and consents from their customers
9. Third-Party Integrations and API Usage
9.1 Integration
The Service may integrate with third-party APIs, platforms, or services (e.g., voice AI providers, analytics services). Your use of these integrations is subject to the terms and policies of those third-party providers.
9.2 Limitations
We do not guarantee the availability, performance, or uptime of third-party services or APIs. Changes or interruptions in third-party services may affect functionality.
9.3 Rate Limiting and Fair Use
API calls may be subject to rate limiting. Repeated or intentional abuse of rate limits may result in throttling, temporary suspension, or permanent termination of access at our sole discretion.
10. Security and Data Protection
We implement industry-standard security protocols, including:
- Encryption of data in transit and at rest
- Access control policies and authentication systems
- Regular security monitoring and auditing
- Incident response procedures
- Employee training on security best practices
In the event of a data breach, we will notify affected users without undue delay and provide information regarding the nature and scope of the breach.
Users are responsible for:
- Enforcing strong password practices
- Maintaining the security of their accounts
- Reporting suspected security incidents promptly
11. Billing and Payments
11.1 Pricing
Service fees are based on the selected plan and may include charges for usage volume, storage, or additional features. Current pricing is available on our website.
11.2 Payment Terms
Payments are due in accordance with the billing cycle selected at signup. Late payments may result in the suspension of access to the Service.
11.3 Refunds
All fees are non-refundable unless required by law or unless the Service fails to meet its core advertised functionality due to verified errors on our part.
12. Service Level Agreement (SLA)
We strive for 99.9% uptime of core features, excluding scheduled maintenance. In the event of unscheduled downtime exceeding 12 hours within a calendar month, Partners may request a service credit.
Scheduled maintenance will be announced in advance through our platform notifications and email communications.
13. Intellectual Property
All intellectual property rights in the Service, including software, AI models, branding, and design, are owned by OYOS Technologies LLC or its licensors.
You retain all rights to your own original content uploaded or created using the platform, including:
- Assessment responses and results
- Voice recordings and transcriptions
- Personal goals and progress data
- Custom content and configurations
You may not reproduce, modify, distribute, or use OYOS content without prior written authorization.
14. Confidentiality
Both parties agree to maintain the confidentiality of non-public, proprietary information disclosed in the course of using the Service and to use such information only as necessary to fulfill the purpose of these Terms.
15. Term and Termination
These Terms remain in effect until terminated by either party.
15.1 Termination by You
You may terminate your agreement by closing your account and ceasing all use of the Service. You remain responsible for any outstanding fees.
15.2 Termination by Us
We may suspend or terminate access for breach of these Terms, non-payment, or violation of our acceptable use policies.
15.3 Effect of Termination
Upon termination, access to the Service will cease, and data may be deleted after a 60-day grace period unless required by law to retain it longer. You may request data export during this period.
16. Disclaimers and Limitation of Liability
16.1 Service Disclaimer
The Service is provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
16.2 Limitation of Liability
We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.
16.3 Maximum Liability
Our total liability to you for any claims arising from or related to these Terms or the Service shall not exceed the amount paid by you to us in the twelve months preceding the claim.
17. Indemnification
You agree to indemnify and hold harmless OYOS Technologies LLC, its officers, employees, and agents from any claims, damages, liabilities, or legal costs arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.
18. Modifications to the Service
We reserve the right to modify or discontinue the Service or any features thereof at any time with or without notice. We will notify users of significant changes that materially affect usage through:
- Email notifications to registered users
- In-platform announcements
- Updates to our website and documentation
19. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Qatar. Any dispute, controversy, or claim arising out of or in connection with these Terms, including their interpretation, performance, or termination, shall be subject to the exclusive jurisdiction of the competent Qatari courts.
Alternatively, parties may agree in writing to refer matters to arbitration in accordance with the Qatar International Court and Dispute Resolution Centre (QICDRC) rules or other recognized arbitration rules within Qatar.
20. Changes to Terms
We may update these Terms from time to time. The most current version will always be available at this page. We will notify users of material changes via email or platform notification.
Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. Archived versions of prior Terms may be requested by contacting our support team.
